Introduction to Policy

All MADSTUDIOS sellers are expected to adhere to the following set of standards to ensure a professional, safe and happy experience for the MADSTUDIOS community. MADSTUDIOS encourages all their creative sellers to provide their customers with the best experience and highest level of service while protecting their own rights. When you list your space and services on MADSTUDIOS, you agree to this policy and our Terms of Service.


Cancellations & Refund Overview

Each Listing on MADSTUDIOS has a Cancellation Policy & Refund Policy. Every Renter is responsible for reviewing the cancellation policy before booking a Booking. Cancellation policies are set in place to protect the Location Manager in the event of unexpected cancellations from a Renter. By booking a Listing, the Renter understands and agrees to all rules (“Do’s And Don’ts”) and terms specified by the Location Manager which includes the cancellation policy.

A Listing’s cancellation policy can be found under the Descriptions tab of the listing. When submitting a booking request, it is imperative to agree to the policy in order to proceed with your booking. Refer back to your booking confirmation to review the cancellation policy after you have accepted the booking.

In the event you need to cancel your booking(s), you may or may not be refunded according to the Cancellation Policy set in place by the Location Manager (which you agreed upon). If the Location Manager needs to cancel your Booking(s), you can choose to rebook or be fully refunded.

MADSTUDIOS and each Location Manager agree to permit the Renter to cancel the booking and refund to the Renter that portion of the Booking Fees specified in the applicable cancellation policy that the Location Manager had selected in that same applicable listing.

Cancellation Policy

MADSTUDIOS allows Location Managers to choose among 3 cancellation policy levels: Flexible, Moderate, and Strict. The Very Strict cancellation policy applies to special circumstances and is by invitation only. These levels of cancellation policies will enforce the protection of both the Renter and Location Manager. Each listing and booking on our site will clearly state the Cancellation Policy. Renters may cancel and review any penalties by viewing their ‘My Bookings’ tab found in the Menu bar. Users may click 'Cancel' on the appropriate booking to cancel a specific Booking.

Levels of Strictness

FLEXIBLE:

100% Refund 24 hours before booking (except fees).

If Booking is canceled less than 24 hours before check-in, the first hour is non-refundable.

If the Renter arrives and decides to leave early, the hours not spent 24 hours after the cancellation are 100% refunded.

  • The MADSTUDIOS service fee is non-refundable.
  • If there is a complaint from either party, notice must be given to MADSTUDIOS within 24 hours after your initial Booking begins MADSTUDIOS will mediate and intervene when necessary situations occur.
  • MADSTUDIOS has the final say in all disputes.
  • A booking is officially canceled when the Renter clicks the cancellation button on a specific Booking under the ‘My Bookings’ tab found in the Menu bar.
  • Cancellation policies may be overridden by the Refund Policy, or In Case of an Emergency. Please review these exceptions.

Example: For a full refund, cancellation must be made a full 24 hours prior to listing’s local arrival time on the day of check in. For example, if your Booking were scheduled for Friday at 5:30 pm, cancellation would have to be submitted before Thursday within that same week at 5:30 pm.

MODERATE:

100% Refund 48 hours before booking (except fees).

If Booking is canceled less than 48 hours before check-in, the first 2 hours are non-refundable.

If the Renter arrives and decides to leave early, the hours not spent 24 hours after the cancellation are 50% refunded.

Example: For a Full refund, cancellation must be made 48 hours prior to listing’s local arrival time on the day of check in. For example, if your Booking were scheduled for Friday at 5:30 pm, cancellation would have to be submitted within that same week, the Wednesday before at 5:30 pm.

STRICT:

50% Refund 7 days before booking (except fees).

If canceled less than 7 days before check-in, no refund.

If the Renter arrives and decides to leave early, the hours not spent 24 hours after the cancellation are not refunded.

  • MADSTUDIOS has the final say in all disputes.

  • Cancellation policies may be overridden by the Refund Policy, or in case of emergencies. Please review these exceptions.

Example: For a 50% refund, cancellation must be made seven full days prior to listing’s local arrival time on the day of check in. For example, if your booking were scheduled for Friday at 5:30 pm cancellation would have to be submitted a week prior, Friday before 5:30 pm.

VERY STRICT:

50% Refund 30 days before booking.

If canceled less than 14 days before check-in, no refund.

If Renter arrives and decides to leave early, the hours not spent are not refunded.

Example: For a 50% refund, cancellation must be made 30 full days prior to listing’s local arrival time on the day of check-in. For example, if your booking is scheduled for Friday, September 13th at 5:30 pm, cancellation would have to be submitted the month before, August 13th at 5:30 pm.


Refund Policy

We encourage Users to create listings that are honest, clear, and helpful to potential Renters. Listings on the MADSTUDIOS platform should meet minimum quality standards regarding safety, access, and cleanliness, and they should be consistent with the description provided by the Location Manager.

If a Renter who books and pays for a Listing and suffers a 'Booking Issue' because the Listing does not meet MADSTUDIOS standards, the Renter may be eligible for a refund in accordance with the Refund Policy.

Three categories in which a 'Booking Issue’ may arise

  1. A Booking is canceled by a Location Manager 24 hours or less before the scheduled start of the booking or fails to provide the Renter with the reasonable ability to access the Listing.
  2. The description of the Listing in the listing on the Site is materially different from the actual Listing (such as the Listing’s size, special amenities or location), or
  3. The Listing is not generally clean or as described.

A Renter is required to bring the Booking Issue to MADSTUDIOS’ attention within 24 hours after the start of your booking in order to submit a valid claim for a refund. This includes photographs and/or other evidence that the renter has collected during their experience to provide evidence of the issue. The Renter must respond to our requests for information and/or cooperation, and not have directly or indirectly caused the Booking Issue. It is also the Renters responsibility to have used reasonable efforts to try to remedy the circumstances of the Booking Issue with the Location Manager prior to making a claim for a Booking Issue.

MADSTUDIOS may, but is not required, to either provide the Renter with a refund or use reasonable efforts to find and book the Renter at another comparable Listing for any unused hours left in a Renter’s reservation, in its sole discretion. The amount of any refund will depend on the nature of the Booking Issue suffered.

ICOE - In Case of Emergency

MADSTUDIOS understands that certain unplanned life situations may occur at any time. In the case of an emergency, MADSTUDIOS may or may not extend a waiver exempting (excusing) the renter of any responsibility to follow through with a particular booking. MADSTUDIOS has the sole authority to reject or cancel a studio Location Manager’s cancellation policy no matter the severity of the matter. However, the renter must provide the appropriate documentation in the event that an emergency occurs unexpectedly. The following situations can be considered reason enough for a valid booking cancellation:

  • Death in the Renter's family (spouse/partner, child, parent, legal guardian, grandparent, or sibling)
  • Serious illness of the Renter or a Renter's family member
  • Natural disaster in the destination country
  • Political unrest in the destination country
  • Jury duty or other similar civil obligations

Intellectual property

Madstudios is a community of creative people. People use the spaces Madstudios provides to make music, paint paintings, rehearse performances, take photos, produce movies, and create a variety of different kinds of art. Respect for the intellectual property both renters and location managers is a must in order to participate in the community.

What is intellectual property?

Intellectual property or IP for short is a creation of the mind like a piece of art, or a song, that belongs to the person who created it. It is the sole right of the person who created a piece of IP to license, sell, market, distribute, and claim ownership of that IP. IP can be legally protected by patents, copyrights, and trademarks. We encourage all of our users to legally protect all IP created with the help of Madstudios.

Here are some guidelines to help you not violate other people's IP rights:

  • Never claim that you created something that you didn’t.
  • Do not sell the IP of another person without their express permission.
  • Don’t save music recordings, images, or videos of renters who use your equipment unless they ask you to do so.

When in doubt, don’t be afraid to ask. Many times you can infringe on someone’s IP rights unintentionally. An example would be posting a picture of a piece of their art to your website. When in doubt your best policy is to ask and keep communication levels high.


Local laws and regulations

Most cities and have some type of laws, ordinances, or regulations that pertain to the rental of owned or leased space to a third party. Every area is different and it is your responsibility to familiarize yourself and abide by these laws.

Some areas may require location managers to register or obtain a permit in order to receive paying guests. Many laws pertain specifically to short-term rentals and sometimes will not allow them at all. These laws and regulations can often be found in a city’s zoning or administrative codes and should be studied and adhered to by all location managers and renters alike.

We trust that all of our location managers will comply with local laws at all times. If you are a location manager, please review your local laws and regulations and make sure that your space is compliant before listing it on Madstudios.


Content Guidelines “DOS & DON’TS”

MADSTUDIOS allows users to add different kinds of content, photos, reviews, private messages, and more. We want everyone to enjoy a “happy” experience when they visit the site that’s why we’ve put together these general guidelines. Please Do become familiar with all of our guidelines.

Listings and Profiles:

Do: We encourage Users to create listings that are honest, clear, and helpful to potential Renters. You can use the "Description" tab to tell people a little something special about your space.

Don’t: Please keep it relevant: don't use this feature to attack your competitors, reviewers, or MADSTUDIOS, and don't use it to seed keywords or post special offers or promotions — we'll remove them if we see them.

Photo Guidelines:

Do: Photos are a great way for users to promote themselves on MADSTUDIOS. Be as creative as you can, but please keep it clean.

Don’t: We don’t condone imagery showing violence, drug use, nudity, near nudity, or suggestive acts.

User Profile:

Do: Use your account profile to let people know who you are and what makes you tick.

Don’t: Don’t leave your profile empty. A complete profile builds trust among other users.

Reviews:

Do: Be relevant, passionate, personal & accurate. The best reviews offer a rich narrative, a wealth of detail, and a helpful tip or two for other users.

Personal experience – Try to give your first-hand experience. Tell your own story.

Relevance – Make sure your reviews are relevant and appropriate.

Accuracy – Make sure your review states the facts. Feel free to express your opinions,

Don’t: Don’t go off rants about political, religious, or social matters that don't address the core of the booking experience.

Don’t embellish or twist your experience. Mad doesn’t take sides when it comes to factual disputes, so say what you mean, & mean what you say.

Inappropriate content:

We hold ourselves and our users to high standards and expect that any and all inappropriate content, either in messages or listings is reported immediately. Keeping all of the content on MADSTUDIOS.com free of racist, sexist, obscene, or violent messaging is every user’s responsibility. Let’s all work to keep MADSTUDIOS a safe and welcoming place for everyone.

Expressing yourself through colorful language & imagery is encouraged, but there's no need for threats, harassment, lewdness, hate speech, and other displays of bigotry. Below are some things that MADSTUDIOS does not allow.

Don’t:

  • Upload content that endorses or promotes illegal or harmful activity or violence, or is profane, offensive, obscene, defamatory, threatening, or prejudiced.
  • Political, religious, or social commentary.
  • Promoting or Advertising other commercial content is strictly prohibited. — We'll remove them if we see them.
  • Content that is fraudulent, false, misleading or deceptive.
  • Efforts to impersonate another person.
  • Content that refers to a MADSTUDIOS investigation.
  • Content that violates another person or entity’s rights, including intellectual property rights and privacy rights.

Review guidelines

Review:

Please take the time to leave a review after your booking. Reviewing allows users to share their experiences and create trust among other creatives in the industry, making our marketplace stronger. You can leave public reviews and provide private feedback to your Location Managers. After your booking time ends, you will receive an email and a notification requesting a review.

  • Always be honest: Please make sure that every review you leave is a genuine objective account of your personal experience with a renter or location manager.
  • Give details: Whenever you leave a review make sure that you’re giving specific details related to your experience. The more articulate you can be about exactly what other users can expect the better.
  • Use appropriate messaging: Refer to our section about inappropriate content that we permit on our review pages.
  • Participate: This is probably the most important part of the whole review system. Reviews don’t work unless people write them, take the initiative and help strengthen our community by writing reviews.

Tip: The best reviews offer a rich narrative, a wealth of detail, and a helpful tip or two for other users.


Creating Your Profile

Your profile is how you present yourself to the Madstudios community. You are encouraged to present yourself in a friendly & professional manner. Profile photos give renters confidence in knowing whom they are booking from. Profile photos should not contain logos.

You are required to use your real first and last name for verification purposes. The first initial of your last name will be only visible to the public on the Madstudios platform.

Please make sure you use an accurate, up-to-date phone number for your profile. Your phone number will only be shared when you complete a booking.

If you need to change your email, please contact hello@madstudios.com with the request. Make sure you include the current email address being used, and the new email you would like it switched to.
